TERMS & CONDITIONS

Effective Date: 6/05/2024

These Terms and Conditions ("Agreement") are entered into by and between Empire Sound Corp ("Empire Sound," "we," "our," or "us") and the client ("Client" or "you") for the provision of event services including DJ entertainment, cinematography, and photo booth rental.

By booking with Empire Sound, you acknowledge and agree to the following terms:

1. Services Provided

Empire Sound agrees to provide services as specified in the client’s booking agreement, which may include:

  • DJ/MC performance

  • Cinematography/videography coverage

  • Photo booth rental and attendant

All services are subject to availability and confirmed only upon signed agreement and deposit.

2. Booking and Payment

  • A non-refundable deposit (typically 25–50%) is required to secure your date.

  • Remaining balance is due no later than 14 days before the event date.

  • Late payments may result in service cancellation without refund.

 

3. Cancellation and Refund Policy

  • Cancellations by the client must be submitted in writing.

  • Deposits are non-refundable.

  • If cancellation occurs within 30 days of the event, the full amount may still be due depending on our loss of business and preparation.

 

4. Client Responsibilities

  • Client shall provide necessary access to the venue, electricity, and required space for equipment setup.

  • Client agrees not to move, tamper with, or obstruct our equipment during service.

  • It is the client’s responsibility to obtain any necessary venue permissions.

 

5. Event Logistics and Changes

  • Client must inform us of any schedule changes, venue access times, or special requirements at least 7 days before the event.

  • Empire Sound is not liable for delays caused by unforeseen venue or client-related issues.

 

6. Equipment and Damage

  • Client is responsible for any damage to Empire Sound’s equipment caused by guest negligence or misconduct.

  • Inappropriate behavior toward staff or equipment may result in early termination of services, with no refund.

 

7. Media Usage & Promotion

  • Unless otherwise requested in writing, Empire Sound reserves the right to use photographs, video clips, and media captured at the event for promotional purposes (e.g., website, social media, advertising).

 

8. Force Majeure

Empire Sound is not liable for non-performance due to circumstances beyond its control, including but not limited to: severe weather, power outages, natural disasters, health pandemics, venue closures, or acts of God.

 

9. Liability Limitations

  • Empire Sound’s liability is limited to the total amount paid for the booked services.

  • We are not responsible for any indirect or consequential damages arising from performance or non-performance.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

11. Entire Agreement

This document, along with the signed booking contract and service invoice, represents the full understanding between both parties and supersedes any prior discussions or arrangements.
